Public Hearing Notice

Public notice is hereby given that the Millcreek Community Reinvestment Agency (the “Agency”) will hold a public hearing on Tuesday, November 13, 2018, commencing at 7:30 p.m. or as soon thereafter as the City Council meeting is completed, at the Millcreek City Hall Annex (south end of parking lot), located at 3330 South 1300 East, Millcreek, UT. The Millcreek Center Community Reinvestment Project Area (the “CRA”) is being proposed for the area between approximately Highland Drive to the east and 900 East to the west, along both sides of 3300 South. The proposed CRA may be declared to have blight. The Agency will notify the record property owners of each additional public hearing held by the Agency concerning the project area prior to the adoption of the project area plan. The purpose of the public hearing is to accept public comment on the blight study completed within the proposed CRA. Record owners of property within the proposed blight survey area have the right to present evidence at the blight hearing contesting the existence of blight. Persons contesting the existence of blight in the proposed CRA may appear before the Agency Board and show cause why the proposed CRA should not be designated as a blighted CRA. Property tax revenues resulting from an increase in valuation of property within the project areas or proposed project areas will be paid to the Agency for project area development rather than to the taxing entity to which the tax revenues would otherwise have been paid, if the proposed project areas are created and the use of tax increment is approved by either a taxing entity committee representing all the taxing entities within the project area, or by interlocal cooperation agreement with one or more of those taxing entities.

The project area plan for the proposed CRA may require the Agency to use eminent domain. The proposed use of eminent domain will be discussed at the Hearing.

Prior to the date of the public hearing, written comments may also be submitted to the Agency. All concerned citizens are invited to attend the hearing. The blight study is available for public inspection at the Millcreek City Municipal Building. Any person may request that a copy of the boundary description of the proposed Millcreek Center project area be sent at no cost to the person by mail, email, or by calling this number: (801) 214-2700. A copy of the boundary description is also available at the following web address: millcreek.us. In accordance with the Americans with Disabilities Act, people with disabilities may make requests for reasonable accommodation, which may include alternate formats, interpreters, and other auxiliary aids and services. The purpose of the public hearing is to accept public comment on each of the following (i) a draft project area plan and budget for the proposed Olympus Hills Community Reinvestment Area, and (ii) a draft project area plan and budget for the proposed Canyon Rim Commons Community Reinvestment Project Area (the “Project Areas”). The draft project area plans provide for the agency to receive tax increment. Property tax revenues resulting from an increase in valuation of property within the project areas or proposed project areas will be paid to the Agency for project area development rather than to the taxing entity to which the tax revenues would otherwise have been paid, if the proposed project areas are created and the use of tax increment is approved by either a taxing entity committee representing all the taxing entities within the project area, or by interlocal cooperation agreement with one or more of those taxing entities.

The Agency has requested $4,614,134 in property tax revenues that will be generated by development within the proposed Olympus Hills Community Reinvestment Project Area and $8,417,197 in property tax revenues that will be generated by development within the proposed Canyon Rim Commons Community Reinvestment Project Area to fund a portion of project costs within those proposed project areas. These property tax revenues will be used for any authorized purpose provided under applicable law and in the plans and budgets. These property tax revenues will be used for the following:

All the property taxes to be paid to the agency for the development in the project areas are taxes that will be generated only if the project area is developed. All persons interested, and present will be given an opportunity to be heard in this matter. Prior to the date of the public hearing, written comments may also be submitted to the Agency. All concerned citizens are invited to attend the hearing. Any person objecting to the proposed Project Areas plans and budgets or contesting the regularity of any of the proceedings to adopt the proposed plans and budgets, may appear before the board at the hearing to show cause why the proposed plans and budgets should not be adopted. The proposed draft project areas plan and budget are available for public inspection at Millcreek City Hall. The CITY OF MILLCREEK is proposing to increase its property tax revenue.
– The CITY OF MILLCREEK tax on a $395,145 residence would increase from $13.47 to $437.18, which is $423.71 per year.
– The CITY OF MILLCREEK tax on a $395,145 business would increase from $24.50 to $794.87, which is $770.37 per year.
– If the proposed budget is approved, CITY OF MILLCREEK would increase its property tax budgeted revenue by 3,153.32% above last year’s property tax budgeted revenue excluding new growth.
